Terms of Service

Please carefully read these Terms before using the Platform or the Services. These Terms affect your legal rights, including limiting CheatChat’s liability and requiring resolution of disputes on an individual, non-class basis.

By accessing or using the Platform or Services, you (i) acknowledge that you have read and understand these Terms and Conditions; (ii) represent and warrant that you are at least eighteen (18) years of age; (iii) consent to the collection, use, and disclosure of your personal information as described in our Privacy Policy; and (iv) agree to be legally bound by these Terms. If you do not agree to these Terms, you must not access or use the Platform or Services.

CheatChat is designed to provide a space for users to share personal experiences and perspectives. We support open expression while maintaining clear boundaries to prevent abuse.

CheatChat does not tolerate harassment, doxxing, threats, or the use of this platform to target individuals in the real world. Any misuse of the platform for these purposes will result in immediate enforcement action, including removal of content, account termination, and, where appropriate, legal escalation.

1Changes to Terms

These Terms are subject to change. You agree that CheatChat may change, terminate, modify, add, end, or delete any of these terms and conditions. We will indicate any such changes or modification by posting the updated version of the Terms on this page and changing the “Effective Date” at the beginning of the Terms.

2Acceptance of Terms and Binding Agreement

These Terms of Service (“Terms”) constitute a binding legal agreement between you (“User,” “you,” or “your”) and CheatChat (“CheatChat,” “we,” “us,” or “our”) governing your access to and use of the CheatChat mobile application, website, and all related services (collectively, the “Services”). By accessing, downloading, registering for, or using the Services in any manner, you affirmatively represent that you have read, understood, and agree to be bound by these Terms and the Privacy Policy, which is incorporated herein by reference.

Your use of the Services is voluntary and undertaken at your own risk. If you do not agree to these Terms in their entirety, you must immediately discontinue use. CheatChat operates solely as a platform for user-generated content and does not create, verify, endorse, or adopt any user submissions.

Your use of the Services, including account creation, content submission, or continued access, constitutes your electronic signature and agreement to these Terms, which shall have the same force and effect as a signed written agreement.

3Eligibility, Account Registration, and Security

You represent and warrant that you are at least eighteen (18) years of age and possess the legal capacity to enter into a binding agreement. You agree to provide accurate, current, and complete information and to maintain its accuracy.

You are solely responsible for maintaining the confidentiality of your account credentials and all activities under your account. CheatChat may associate your account with technical identifiers including IP addresses, device identifiers, and session data for enforcement, fraud prevention, and compliance purposes.

You may not sell, transfer, or assign your account, or impersonate any individual or entity. CheatChat reserves the right, at any time and in its sole discretion, to require identity verification, including submission of documentation or authentication measures. Use of false information or impersonation constitutes a material breach and may result in immediate termination and forfeiture of access.

CheatChat may suspend, restrict, or terminate any account at any time, with or without notice.

4Nature of the Platform; Fictionalization; No Reliance; No Confidentiality

CheatChat is a platform for storytelling, commentary, and expressive content. All content is user-generated and may be fictionalized, anonymized, exaggerated, incomplete, or inaccurate.

All content shall be treated as narrative expression and not as verified fact. CheatChat does not independently verify submissions and disclaims any responsibility for the accuracy, reliability, or completeness of any content. You agree not to rely on any content as factual or actionable information.

All submissions are non-confidential and non-proprietary. You waive any expectation of privacy in content submitted to the platform. Content may be publicly displayed, redistributed, modified, and used by CheatChat or third parties.

5User Certification and Posting Obligations

As a condition precedent to submitting any content, you must affirmatively certify that your submission complies with these Terms. You represent, warrant, and affirm that your content is either (i) fictionalized or anonymized, or (ii) if referencing a real individual, limited to non-sensitive identifying details and fully compliant with Section 6.

You expressly certify that you have not included, and will not include, any information that could reasonably be used to identify, locate, contact, or target any individual in the real world, including but not limited to home addresses, phone numbers, email addresses, workplace information, government-issued identifiers, or any combination of details that would enable identification.

You further represent and warrant that: (i) your content reflects your personal experience, opinion, or narrative; (ii) any statements presented as fact are true and capable of substantiation; (iii) your submission is not knowingly false, misleading, or fabricated; and (iv) you have not included identifying information with the intent or foreseeable effect of harassing, threatening, extorting, or harming any individual.

You acknowledge and agree that you are solely responsible for your content and any legal claims arising from it, including but not limited to claims for defamation, libel, false light, invasion of privacy, or misappropriation, and you expressly assume all risks associated with the inclusion of any identifying details.

This certification is recorded along with associated metadata, including timestamps, IP addresses, and device identifiers, and constitutes a material inducement for CheatChat’s publication of your content. Any breach of this certification shall constitute a material breach of these Terms and may result in immediate enforcement action, including content removal, account termination, and pursuit of all available legal remedies.

6User Content; Identification; Prohibited Content

CheatChat permits users to submit content that may reference or describe real individuals, including limited identifying details, provided that such content complies with these Terms. You acknowledge and agree that CheatChat does not create, solicit, verify, endorse, or adopt any such content and acts solely as a passive platform for user-generated submissions.

As a condition of submitting any content referencing another individual, you represent, warrant, and affirm that: (i) the content reflects your personal experience, opinion, or narrative; (ii) any statements presented as fact are true and capable of substantiation; (iii) the content is not knowingly false, misleading, or fabricated; and (iv) you have not included identifying information with the intent to harass, threaten, extort, or harm any individual.

You further agree that you are solely responsible for all content you submit, including any legal claims arising from such content, including but not limited to claims for defamation, libel, false light, invasion of privacy, or misappropriation. CheatChat disclaims all liability for user-generated content to the fullest extent permitted by law and shall not be treated as the publisher or speaker of such content.

Notwithstanding the foregoing, you are strictly prohibited from submitting content that: (i) includes sensitive personal information such as social security numbers, financial account information, home addresses, phone numbers, or government-issued identification details; (ii) is knowingly false or intentionally misleading; (iii) constitutes unlawful harassment, threats, or extortion; or (iv) violates any applicable law or regulation.

CheatChat reserves the absolute right, but not the obligation, to remove, restrict, or modify any content that it determines, in its sole discretion, may create legal risk, violate these Terms, or expose CheatChat or any third party to harm. CheatChat may take such action with or without notice and without liability to any user.

You acknowledge that the inclusion of identifying details in user-generated content may increase the risk of legal claims, and you expressly assume all such risk. You agree to defend, indemnify, and hold harmless CheatChat from any claims, damages, liabilities, costs, and expenses arising out of or relating to your content, including any claims brought by third parties referenced in such content.

7Platform Use Restrictions and Technical Protections

You agree not to misuse the Services or engage in any activity that interferes with, exploits, or undermines the platform. Prohibited conduct includes, without limitation, scraping, harvesting, or extracting data; using bots, automation, or artificial intelligence tools to access or collect content; reverse engineering or attempting to access source code; circumventing moderation, security, or access controls; republishing or commercially exploiting platform content; impersonating users or misusing credentials; or using platform-derived information to contact, harass, or target individuals outside the platform.

You further agree not to capture, reproduce, distribute, publish, transmit, display, or otherwise exploit any content obtained through the Services outside of the platform, including through screenshots, recordings, or any similar method.

Any unauthorized extraction or redistribution of content constitutes a material breach and may result in enforcement action, including damages and injunctive relief.

You are strictly prohibited from using the Services or any content obtained through the Services to identify, locate, surveil, contact, harass, threaten, or harm any individual outside the platform. This includes attempting to match anonymized content to real individuals, facilitating off-platform harassment, or encouraging third parties to engage in such conduct.

Any attempt to weaponize platform content for real-world targeting, retaliation, or coordinated harassment constitutes a material breach and may result in immediate termination, legal action, and referral to law enforcement.

8Content Moderation and Platform Discretion

CheatChat may implement automated and manual moderation systems. CheatChat reserves the absolute right, but not the obligation, to monitor, review, remove, restrict, or modify any content or account at any time, with or without notice.

Moderation decisions are final and discretionary and do not create any duty or liability.

9User Content License and AI/Data Rights

By submitting content, you grant CheatChat a perpetual, irrevocable, worldwide, royalty-free, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, distribute, display, and otherwise exploit such content for any lawful purpose.

This includes use for moderation, analytics, marketing, algorithmic ranking, and the training, development, and commercialization of artificial intelligence and machine learning systems. You acknowledge that outputs derived from such systems are exclusively owned by CheatChat.

CheatChat may utilize automated systems to review, moderate, prioritize, and recommend content. You consent to such automated processing and agree that CheatChat is not obligated to provide explanations or human review.

You waive any claims related to attribution, integrity, or reputational harm arising from the use or modification of your content.

10Complaints, Investigations, and Data Disclosure

CheatChat may investigate complaints or legal requests and may preserve and disclose user data, including content and metadata, without notice where necessary to comply with law, enforce rights, or mitigate risk.

CheatChat may remove or restrict content upon receipt of complaints without liability. Users agree to indemnify CheatChat from any third-party claims arising out of their content.

Users may submit counter-notifications; however, all determinations remain within CheatChat’s sole discretion.

Users may report suspected violations of these Terms, including unlawful or harmful content, by contacting CheatChat at legal@cheatchat.com. CheatChat may act on such reports in its sole discretion.

11Data Security, Retention, and Minors

CheatChat implements commercially reasonable measures to protect data but does not guarantee security. You acknowledge that no system is secure and assume all risks associated with data transmission and storage.

To the fullest extent permitted by law, CheatChat shall not be liable for unauthorized access, breaches, or third-party intrusions.

CheatChat retains data as necessary for operational, legal, and enforcement purposes. Deletion requests do not guarantee complete removal, and data may be retained in backups, logs, or anonymized formats.

The Services are not intended for individuals under eighteen (18). CheatChat does not knowingly collect information from minors and reserves the right to delete such data and terminate accounts upon discovery.

12DMCA and Intellectual Property Compliance

CheatChat complies with the Digital Millennium Copyright Act (17 U.S.C. § 512). To submit a claim of copyright infringement, you must provide a written notice that satisfies all applicable legal requirements.

CheatChat will, in appropriate circumstances and at its sole discretion, terminate the accounts of users who are determined to be repeat infringers.

CheatChat may remove or disable access to allegedly infringing content upon receipt of a compliant notice and may take such action without prior notice to the user.

Users may submit counter-notifications in accordance with applicable law. Upon receipt of a valid counter-notification, CheatChat may restore the removed content unless the complaining party initiates legal action within the time period required by law.

13Enforcement, Damages, and Equitable Relief

CheatChat reserves the right to enforce these Terms through any lawful means, including suspension, termination, content removal, technical restrictions, and legal action.

You acknowledge and agree that violations of these Terms, including but not limited to breaches involving prohibited content, identification of individuals, unauthorized data extraction, redistribution of content, or circumvention of platform safeguards, may cause substantial harm to CheatChat, including reputational damage, regulatory exposure, loss of business opportunities, and costs of investigation and remediation, the full extent of which would be difficult or impracticable to ascertain with precision at the time of contracting.

Accordingly, you agree that, for each material violation of these Terms, CheatChat shall be entitled to liquidated damages in the amount of ten thousand U.S. dollars (USD $10,000) per violation. You expressly acknowledge and agree that this amount represents a reasonable and proportionate estimate of the damages that CheatChat is likely to incur as a result of such violations and is not intended as a penalty.

You further agree that this liquidated damages provision is cumulative and applies on a per-violation basis, including separate violations arising from distinct acts, content submissions, or attempts to circumvent enforcement measures.

The parties agree that the foregoing liquidated damages are appropriate given the nature of the Services, the risk of rapid and widespread dissemination of content, the difficulty in quantifying reputational and legal harm, and the administrative burden associated with investigating and responding to violations.

In addition to liquidated damages, CheatChat shall be entitled to recover its reasonable attorneys’ fees, costs, and expenses incurred in enforcing these Terms, to the fullest extent permitted by law.

You further acknowledge that any violation of these Terms may result in irreparable harm for which monetary damages alone would be inadequate, and CheatChat shall be entitled to seek injunctive or equitable relief without the requirement of posting bond or proving actual damages.

Nothing in this section shall limit CheatChat’s right to seek actual damages in excess of the liquidated amount where permitted by law, or to pursue any other remedies available at law or in equity.

14Disclaimer of Warranties and Limitation of Liability

The Services are provided “as is” without warranties of any kind. CheatChat disclaims all warranties including merchantability and fitness for a particular purpose.

To the fullest extent permitted by law, CheatChat shall not be liable for any indirect or consequential damages. Total liability shall not exceed $100.

15Platform Status and Legal Protections

CheatChat is an interactive computer service provider under Section 230 of the Communications Decency Act and shall not be treated as the publisher or speaker of user-generated content.

16Pre-Dispute Resolution Requirement

Before initiating arbitration or legal action, you must provide written notice of dispute including detailed facts and supporting documentation. The parties agree to attempt good faith resolution for forty-five (45) days before proceeding.

17Dispute Resolution, Arbitration, and Governing Law

All disputes shall be resolved exclusively through binding arbitration administered by JAMS under the Federal Arbitration Act in New York County, New York. Arbitration shall be conducted on an individual basis and class actions are waived.

The arbitrator shall have exclusive authority to determine arbitrability. New York law governs these Terms.

18Third-Party Services and External Links

CheatChat is not responsible for third-party services or external links. Use of such services is at your own risk.

19Mobile Application Terms

If accessed through Apple or Google platforms, such platforms are not parties to these Terms and bear no responsibility for the Services.

20Fees, Billing, and Subscription Terms

Certain features of the Services may require payment. By purchasing any paid feature, you agree to pay all applicable fees as disclosed at the time of purchase. All payments are final and non-refundable except where required by law. You expressly waive any right to dispute or reverse charges except in cases of verified unauthorized transactions.

Subscriptions, if offered, will automatically renew unless canceled prior to the renewal date. You authorize CheatChat or its payment processor to charge your payment method on a recurring basis.

Initiating a chargeback, payment reversal, or fraud claim in connection with a valid charge constitutes a material breach of these Terms and may result in immediate account termination and permanent restriction from the Services.

CheatChat reserves the right to pursue recovery of disputed amounts, including costs, fees, and collection expenses, to the fullest extent permitted by law.

21General Provisions

These Terms constitute the entire agreement between you and CheatChat with respect to the Services and supersede all prior or contemporaneous understandings, whether written or oral.

If any provision of these Terms is held to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.

CheatChat may assign, transfer, or delegate these Terms, in whole or in part, without restriction and without notice. You may not assign or transfer any rights or obligations under these Terms without CheatChat’s prior written consent, and any attempted assignment in violation of this provision shall be null and void.

CheatChat reserves the right to modify these Terms at any time in its sole discretion. Updated Terms will be posted on the Platform with a revised effective date, and your continued access to or use of the Services constitutes your binding acceptance of such modifications.

All provisions of these Terms that by their nature should survive termination, including but not limited to provisions relating to intellectual property, user content, indemnification, limitation of liability, dispute resolution, and enforcement, shall survive termination or expiration of these Terms.

These Terms are written in the English language. Any translated version is provided for convenience only. In the event of any conflict or inconsistency, the English version shall control.

No failure or delay by CheatChat in exercising any right, power, or remedy under these Terms shall operate as a waiver of such right, power, or remedy, nor shall any single or partial exercise preclude any other or further exercise thereof.

Section headings are for convenience only and shall not affect the interpretation of these Terms.

CheatChat shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including without limitation acts of God, government action, cyberattacks, system failures, infrastructure outages, labor disputes, or interruptions in third-party services.

All legal notices must be sent in writing to the foregoing address. CheatChat reserves the right to designate alternative contact methods by updating these Terms.

23Jurisdiction-Specific Limitations and Carve-Outs

Nothing in these Terms shall be interpreted to waive, limit, or exclude any rights that cannot be waived under applicable law. To the extent any provision of these Terms is determined to be invalid, unenforceable, or restricted under applicable law, such provision shall be modified and enforced to the maximum extent permitted so as to reflect the original intent of the parties as closely as possible.

To the fullest extent permitted by law, the parties agree that all provisions relating to dispute resolution, arbitration, limitation of liability, indemnification, and enforcement shall remain in effect and be enforced to the maximum extent allowable.

If any portion of the arbitration agreement is found to be unenforceable in a particular jurisdiction, the parties agree that any such dispute shall be resolved exclusively in the state or federal courts located in New York County, New York, unless otherwise required by applicable law, and all remaining provisions of these Terms shall continue in full force and effect.

Where mandatory local law provides users with specific rights or remedies, such rights shall apply only to the extent required and shall not expand or otherwise modify the remaining provisions of these Terms.

California Residents. Users residing in California may have rights under the California Consumer Privacy Act (CCPA/CPRA), including the right to request access to and deletion of personal information, subject to applicable exceptions.

EEA/UK Users. If you are located in the European Economic Area or United Kingdom, you may have rights under applicable data protection laws, including the GDPR, such as rights of access, rectification, and erasure.

New York Residents. Nothing in these Terms shall limit rights that cannot be waived under New York law.

International Users. You are responsible for compliance with local laws. Where mandatory law applies, such provisions shall govern only to the extent required.
